Govt’s Aadhaar-PAN linkage comes under SC lens

Supreme Court has given a big blow to Government of India. In an order, the court has said that it will examine if the decision of the center government to make Aadhar card mandatory for PAN cards for filing income tax returns is required.

This order was passed by Justice AK Sikri and Ashok Bhushan who said that Aadhar was made mandatory even as the court had observed that it could only be optional. The court pointed out that it is examining the validity of this order of Government and that the matter has been referred to a constitutional bench. The government in its defense on making Aadhar card mandatory had said that people were making multiple PAN cards which were being used to divert funds for shell companies and if Aadhar was linked, it would curb such practices.

The court made all these observations in response to the plea filed by CPI leader and former minister from Kerala Binoy Viswam who had challenged amendments in the IT act which made it mandatory to quote Aadhar while filing the income tax returns.

The bench has proposed April 26 as the next date of hearing in this case and will listen to the defense prepared by the Government in this case.
